TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

By engaging Vintage 4WD for any services, purchasing goods, or entering our premises, you ("Customer") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. SERVICES PROVIDED

Vintage 4WD specializes in automotive restoration services including but not limited to general repairs, specialist repairs, routine maintenance, full restorations, and custom fabrication of specialty parts for vintage 4WD vehicles. We prepare vehicles for off-road adventures, expeditions, and demanding terrain conditions.

3. LIMITATION OF LIABILITY

3.1 No Liability for Services

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VINTAGE 4WD SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO OUR SERVICES, INCLUDING BUT NOT LIMITED TO:

  • Vehicle breakdown or failure during or after service

  • Loss of use of vehicle

  • Personal injury or property damage

  • Business interruption or lost profits

  • Damage to cargo or personal property in vehicle

  • Accidents or incidents occurring during off-road use

3.2 No Liability for Goods

VINTAGE 4WD DISCLAIMS ALL LIABILITY FOR PRODUCTS SOLD, INCLUDING CUSTOM FABRICATED PARTS, BEYOND THE LIMITED WARRANTY SET FORTH HEREIN.

3.3 Maximum Liability Cap

IN NO EVENT SHALL VINTAGE 4WD'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY CUSTOMER FOR THE SPECIFIC SERVICE OR PRODUCT GIVING RISE TO THE CLAIM.

4. LIMITED WARRANTY

4.1 Warranty Period

Vintage 4WD provides a limited warranty on workmanship for a period of ninety (90) days from completion of service or thirty (30) days for custom fabricated parts, whichever applies.

4.2 Warranty Coverage

This warranty covers defects in workmanship performed by Vintage 4WD. Warranty remedy is limited to repair or replacement of defective workmanship at our sole discretion.

4.3 Warranty Exclusions

This warranty DOES NOT cover:

  • Normal wear and tear

  • Damage from off-road use, racing, or extreme conditions

  • Damage from improper maintenance or use

  • Parts not supplied or installed by Vintage 4WD

  • Electrical components or electronic systems

  • Damage from accidents, abuse, or modifications by others

  • Consequential or incidental damages

4.4 Warranty Disclaimer

EXCEPT FOR THE LIMITED WARRANTY SET FORTH ABOVE, ALL SERVICES AND GOODS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. VINTAGE 4WD DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

5. CUSTOMER ACKNOWLEDGMENTS

5.1 Vehicle Condition

Customer acknowledges that vintage vehicles inherently present risks and may have unknown defects or wear patterns that cannot be detected without complete disassembly.

5.2 Off-Road Use Risks

Customer acknowledges that vehicles prepared for off-road use involve inherent risks and that no guarantee is made regarding performance in extreme conditions.

5.3 Parts Availability

Customer acknowledges that vintage parts may be obsolete, discontinued, or require custom fabrication, which may affect timeline and cost.

6. INDEMNIFICATION

Customer agrees to indemnify and hold harmless Vintage 4WD, its owners, employees, and agents from any claims, damages, or expenses arising from Customer's use of the vehicle or services provided.

7. DISPUTE RESOLUTION

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to reasonable attorney's fees.

8. GOVERNING LAW

These terms are governed by the laws of the State of California without regard to conflict of law principles.

9. SEVERABILITY

If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10. ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between the parties and supersede all prior agreements or understandings.

11. MODIFICATION

These terms may only be modified in writing signed by both parties.
